MEDIATION TRAINING COURSE DESCRIPTIONS


International Mediation
: Around the World in 8o Ways


Beginning at 10:00AM and ending at 4:30PM, this 6 credit course is eligible for 1 hour of diversity, 1 hour of domestic violence and 4 hours of general mediation. It develops important information for international lawyers and mediators who currently want to expand their legal international practice or develop a practice in international or commercial mediation. Whether mediating domestically or abroad, acquiring skills to mediate in an increasingly culturally diverse world is important. This course will explore the explosive development of mediation in various regions around the world, primarily from an international commercial mediation perspective. It will discuss expansion of mediation in developed nations and some under-developed nations, as well as or nations which currently are on the U.S. trade embargo list, such as Cuba and Iran. Aspects of not only commercial mediation, but also court-related mediation will be addressed in particular regions, such as southeastern Europe and the Middle East. Particular aspects of violence, particularly violence in domestic relations, will be briefly explored from an international perspective in these regions as well.

This course is a pre-requisite for the Mediation Course, So You'd Like to Work Overseas, for those mediators who want to work overseas in mediation or related activities.

This course will be eligible for 1 hour of domestic violence and 1 hour of diversity/cultural awareness, for a total of 6 CME credits. Lunch and refreshments are provided.

Ethics in Culturally and Religiously Diverse Mediations


This 5 hour course in ethics is eligible for 4 hours of ethics and 1 hour of diversity. Based, in large part, upon the Dispute Resolution Center's Mediator Ethics Advisory Committee Opinions, interactive ethic scenarios also will relate to Advertizing and Solicitation; Business Practices; Confidentiality; and, Conflicts of Interest. The course also will explore power imbalances and various ethical questions of current interest in cultural and religiously diverse mediations. The United States, as well as other countries, is experiencing an increasing awareness that differences in culture, including religious divergences, play key roles in the handling and success of mediations. Mediators need to be keenly aware of and attentive to ethical issues involving mediations of diverse participants.

This 5 hour course is eligible for all of the required 4 hours of ethics and the required l hour of diversity, for a total of 5 CME credits. Courses on topics, such as ethics, may be credited to any or all of the areas of mediation certifications. Lunch and refreshments provided.

International Mediation: So You’d Like to Work Overseas in Mediation?

This 6 hour course in International Mediation, Working Overseas, is eligible for 1 hour of diversity. the Academy of Mediation Training has as its philosophy that mediation, at its core, is a peace-building tool. More and more mediators and others in related fields are looking for opportunities to work in troubled locations worldwide to support post-conflict communities in managing, preventing, resolving and healing from conflict through mediation and related techniques. This 7 hour course will explore what opportunities exist to either build an international mediation practice or to experience the use mediation techniques in regions of the world healing from conflict.

This course will be eligible for 1 hour of diversity/cultural awareness, for a total of 7 CME credits for Circuit and County Mediators. Lunch and refreshments are provided. In addition to the course, each participant will receive one additional hour of coaching within the first year after completion of the course.

Completion of the course, International Mediation: Around the World in 8o Ways, is strongly suggested. DVDs are available for purchase on-line to take this course.

Basic Commercial Mediation

This 5-hour course is eligible for 1 hour of diversity. It will emphasize problem-solving and reasoning skills through practical experience in business and commercial mediation processes. The course will assist the mediator in understanding and assessing the particular nature, process, and advantages and disadvantages of mediating commercial and business disputes. Mediators will explore this non-litigation, non-adjudicative method from the perspective of a practicing mediator with at least one year of practical experience. The issues of professional and ethical responsibilities in conjunction with how mediators, lawyers and clients participate in commercial dispute resolution processes also will be addressed.

Mediator attendees will be assigned and are expected to actively participate in simulations, role-plays and exercises designed to explore and understand the methodology and process of mediation techniques in commercial and business mediations. Attendees will actively participate in one or more role-plays discussing business disputes in intellectual property and contracts.

Mediators are also expected to participate in roundtable discussions with each group assigned various investigations and discussions.

This course will be helpful to mediators seeking to expand their expertise in court-related mediation. This course will be eligible for 1 hour of diversity/cultural awareness, for a total of 6 CME credits for Circuit and County Mediators and all other mediators who want to expand courtrelated mediation practice. Lunch and refreshments are provided.

Advanced Commercial Mediation

This 6 hour course is eligible for 1 hour of diversity credit. It will review, assess and study emerging methods and processes of resolving sophisticated commercial and business disputes, other than by traditional litigation and adjudication in a court of law. Similar mediation techniques in the US, EU, UNICITRAL and other countries also will be explored. Latest developments in cross border and international business mediation will be discussed.

The concepts of co-mediation, multi-cultural and cross border business mediation and multiparty mediation will be explored. Current and cutting-edge business trends in mediation will be discussed.

Mediator attendees will be assigned and are expected to actively participate in simulations, role-plays and exercises designed to explore and understand the methodology and process of mediation techniques in commercial and business mediations.
